Medical Malpractice
A very complicated type of personal injury claim
These are the kinds of medical malpractice cases that most often come to my attention:

To err is human
To Err is Human is the name of a report by the Institute of Medicine, which concluded that between 44,000 to 98,000 people die each year in the United States as a result of preventable medical errors. By comparison, that is more deaths than those due to vehicular accidents, breast cancer, drug addiction, or AIDS.
Prescription medication errors are among the most common medical mistakes in the nation. According to the same report, nearly 1.5 million people are injured every year as a result of medication errors. The report also found that the cost of treating injuries due to medication errors is $3.5 billion annually, not including lost wages. In total, the study found that nearly 400,000 medication-related injuries occurred in hospitals, 800,000 occurred in long-term healthcare facilities, and 530,000 occurred with Medicare patients.
If human error were tolerated to the same degree in the aviation industry, there would be the equivalent of three jumbo-jet crashes every two days.
If a loved one died due to a medication or medical error, or if you are injured due to a hospital, medication, surgical, or doctor's error, let Robert W. Elton get you the compensation you and your family deserve.
Nursing home negligence
In Florida, nursing home negligence is a major quality of life issue and one of the saddest things that can happen to an elderly person.
The state of Florida has passed laws giving nursing home residents specific rights including the right to receive adequate and appropriate healthcare, protective and support services, and the right to be free from mental and physical abuse.
We will obtain the records and evidence necessary to investigate violations of a loved one’s rights, and take the appropriate action.
The law limits the time you have to file a malpractice claim
In Florida, the time limit for starting a malpractice claim is not obvious. Generally you must start a claim within two years from the time the malpractice occurred, or two years from the time you knew or should have known of the malpractice, but no longer than four years from the time it occurred.
You should not delay in seeking legal advice if you or a loved one is injured due to a medical error or malpractice. Call or contact me for a free consultation.
