Civil Litigation

When your business, your home, or your job gives rise to legal problems you can’t work out, you should usually consider legal advice and representation.
Again, early consultation with an experienced attorney can often make the difference. My law firm most often assists people in these areas of civil law:

Commercial litigation
As technology and government complicate today's commercial climate, business owners and individuals can find themselves faced with confusing issues and possible litigation.
Generally individuals and businesses should try to avoid courtroom collisions with one another, or with the government. Often civil attorneys with experience can resolve matters without costly litigation.
We have experience resolving commercial and contract disputes, and litigating them if they can’t be resolved.
Mortgage foreclosure defense
Thousands of Florida homeowners have fallen behind on their mortgage payments because of the economy and unemployment.
When a homeowner is in default, Florida law allows the lender (mortgagee) to file a lawsuit against the homeowner to foreclose on the mortgage.
Florida law allows the homeowner to contest or defend the suit. If you are in default, you need an experienced attorney to defend against the foreclosure.
You may qualify for relief under President Obama’s Making Home Affordable program, Florida's Save Our Homes plan, or another plan that would allow you to lower your monthly payments, or there may be technical defects in the loan or the foreclosure suit.
Predatory lending: Some foreclosures can be defeated (or worked out) because of predatory lending such as lending without regard to the homeowner’s ability to pay, excessive lending fees, loan flipping (unjustified refinancing repeatedly to make fees) and other lending abuses.
If you were served with a foreclosure suit, you or your attorney must file a responsive pleading within 20 days. Early intervention is the key to success: Contact Bob Elton by email or phone.
Construction Disputes
When you build a residence or a commercial building, or any other construction project, it is almost impossible to get through the entire project without a few disputes. Those disputes are usually minor in nature and are generally worked out between the contractor and project owner.
Major disputes that can’t be settled by the contractor and project owner proceed on to mediation, binding arbitration, or litigation—whichever is specified in the construction contract—to settle the dispute completely.
If there is no provision for dispute resolution in a construction contract, either party, including the contractor, has the right to sue the other party using the court system.
Whether you are a homeowner, a commercial owner or a contractor or subcontractor, an experienced construction attorney like Robert W. Elton can help.
Homeowner Claims
Sometimes homes, roofs, or appliances have defects and cause damage to homeowners and tenants. These claims often require an experienced attorney and an expert to ensure that the homeowner gets a fair resolution of the problem. Again, call early for help.
Employment law

Labor disputes may involve courtroom trials and negotiated settlements over—

Employment and labor laws are supposed to equalize the power distribution between employers and employees. As an employee, you have the right to form or join a union, to picket, to strike, to work in a safe place, and many others. If your employer has violated any of your rights, it is entirely appropriate to seek legal help for your problem.
Up front, I can advise you to keep records of the problematic things that may be happening to you on the job and get in touch with a lawyer experienced in labor law. Find my contact information in the next section of this page.
